1. Acceptance of Terms & Age Requirements
By downloading, accessing, or using Shale (the "App"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service. You must be at least 13 years of age (or the minimum age of digital consent in your country) to create an account and use this App.
2. Description of Service
Shale is a flashcard and studying application designed to help users learn and earn screen time. The App relies on external platforms (like Apple's Screen Time APIs) which are subject to their respective terms.
3. User Accounts
You must provide accurate information when creating an account (via Google or Apple). You are responsible for safeguarding your login credentials and for any activities or actions under your account.
4. User-Generated Content
You retain all rights to any flashcards or decks you submit, post or display on or through the App. By posting content, you grant Shale a license to use, store, and display that content solely for the purpose of providing the service to you.
5. Prohibited Activities
You agree not to use the App to create or distribute illegal, abusive, or harmful content. We reserve the right to terminate accounts that violate these terms without notice.
6. Limitation of Liability
In no event shall Shale, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
7. Subscriptions and Auto-Renewal
Shale offers premium features through auto-renewing subscriptions (e.g., Weekly, Monthly, or Yearly) and lifetime purchases. If you choose to purchase a subscription, payment will be charged to your Apple ID account at the confirmation of purchase. The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.
8. Apple App Store EULA Acknowledgment
If you downloaded the App from the Apple App Store, you acknowledge and agree that these Terms are concluded between you and Shale only, and not with Apple. Shale, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App. You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Service.
